ABHISHAG ROY Vs. STATE OF KERALA

JUDGEMENT

(1.) This is the second application seeking bail. The earlier application was dismissed by order dtd. 27/11/2023, finding the involvement of the petitioner and noticing the fact that the rigour under Sec. 37 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985, as commercial quantity is involved.

(2.) By the order of this Court dtd. 14/2/2024, a report was called for from the Court concerned as to the probable time required for disposal of the case pending before it. A report has been filed on 16/2/2024, intimating that the case can be disposed of within 9 months. This is recorded. Since there is no change of circumstances, I am not inclined to consider the request for bail.

(3.) Taking note of the above report of the Court below, I am directing the Court concerned to make every endeavour to stick to the timeline indicated in the report and to dispose of the case within that time.
