JUDGEMENT

(1.) THE grievance of the petitioners in both these cases is almost similar, ie, with regard to the compulsion on the part of the concerned respondents making the petitioners study Malayalam and take examination in respect of Malayalam paper I and II. It is stated that by virtue of the relevant orders passed by the Government and the departmental authorities concerned, it is open for the petitioners to study and appear for the examinations by writing 'Special English' and 'Additional English', instead of Malayalam paper I and II. But the said course is not being permitted by virtue of inaction and lapse on the part of the authorities of the 5th respondent/School. Hence the Writ Petition, with the following prayers as given in W.P (C).No.15884 of 2014. (i) Issue a writ of certiorari or any other appropriate writ, order or direction calling for the records pertaining to Ext.P5 and P6 and quash the same. (ii) Declare that the petitioner is entitled to complete her 10th standard exempting her from studying Malayalam studying Special English and Additional English in view to Exts.P2, P3, P4, P7 and P8. (iii) Issue a writ of mandamus or any other appropriate writ, order or direction, commanding respondents 1 to 4 to direct the 5th respondent to allow the petitioner to write her Additional English and Special English instead of Malayalam -I and II papers in all the forthcoming examinations mentioned in Ext.P9 school calendar and further allow the petitioner to write her S.S.L.C examinations in the month of March 2015 writing Special English and Additional Malayalam instead of Malayalam I and II papers. (iv) To issue such other reliefs or orders as this Hon'ble Court may deem fit and proper in the interest of the above case.

(2.) DESPITE the completion of service of notice, no counter affidavit has been filed by the 5th respondent so far.
