JUDGEMENT

(1.) This is an application for regular bail under Sec. 439 of the Code of Criminal Procedure filed by the 1st accused in Crime No.633 of 2023 of Karipur Police Station.

(2.) The prosecution allegation is that on a day, 2' months prior to 27/9/2023, at about 04.00 p.m., the petitioner/1st accused kidnapped the victim boy, who is a minor aged 15 years, in a car to a room near to the Mosque at Kumminipparambu and committed penetrative sexual assault on him and gave Rs.450.00 as gratification.

(3.) Learned Public Prosecutor produced copy of the CD along with report of the investigating officer for the purpose of this application.
