(1.) The petitioner is the 2nd accused in C.C.No.428 of 2022 on the files of the Additional Chief Judicial Magistrate Court, Thalassery. The offences alleged are those under Ss. 143, 147, 148, 448, 341, 323, 324, 326 and 149 of the Indian Penal Code. A non-bailable warrant is pending against the petitioner. According to the petitioner, the petitioner left India in the year 2021 in connection with employment in Saudi Arabia and the final report was filed in the year 2022. It is submitted that the petitioner could not appear before the court only on account of the fact that the petitioner was abroad in connection with his employment.

The learned counsel for the petitioner submits that the only relief sought for is for a direction to the Additional Chief Judicial Magistrate Court, Thalassery where C.C.No.428 of 2022 is pending to consider any bail application that may be filed by the petitioner on the day which the petitioner surrenders before that court. It is submitted that the petitioner will surrender within a period of ten days from today.
(3.) Heard the learned Public Prosecutor also. Having regard to the facts and circumstances of the case and considering the relief sought for by the petitioner, this petition will stand disposed of directing the Additional Chief Judicial Magistrate Court, Thalassery to consider any bail application that may be filed by the petitioner in C.C.No.428 of 2022 on the same day on which the petitioner surrenders before that court. This order shall operate only if the petitioner surrenders before that court within a period of ten days from today.
