JUDGEMENT

(1.) The writ petition is filed challenging Ext.P4 order declining to grant permit for constructing a residential building on the ground that the property in question is covered by Kerala Conservation of Paddy Land and Wet Land Act. Petitioner has filed Ext.P7, which is an application in form 7 under Rule 12(1) of the Kerala Conservation of Paddy Land and Wet Land Act, 2008 on 29/6/2022 before the Revenue Divisional Officer, Thodupuzha. The petitioner prays for a direction for consideration of his application in accordance with law, taking into account the report filed by the Agricultural Officer pursuant to the interim order of this Court on 11/11/2022 The Revenue Divisional Officer, Thodupuzha is suo motu impleaded as additional 5th respondent in this writ petition.

(2.) In the above circumstances, there will be a direction to the additional 5th respondent to consider and pass appropriate orders on Ext.P7, taking into account the report filed the Agricultural Officer before this Court as per the interim order of this Court dtd. 11/11/2022. It shall be done after hearing the petitioner within an outer time limit three months' from the date of receipt of a copy of this judgment.
