IN these original petitions, opposite parties in the various complaints before the Consumer Dispute Redressal Forum, Alappuzha ( for short, "the Forum") challenge Ext.P4, order whereby the interim attachment of their assets already made was made absolute and they were directed to pay to the first respondent/complainant various amounts as stated in Ext.P4, order with interest.
(2.) IT is contended by the learned counsel that since petitioners are only legal representatives of deceased partners of the firm, they have no liability to the debt of the firm. It is also contended that since petitioners are not partners of the firm, they had no obligation to appear before the Forum pursuant to the notices served on them. Learned counsel has invited my attention to Rule 7 of Order XXX of the Code of Civil Procedure (for short, "the Code"). The learned counsel, placing reliance on various authorities contends that as the Forum has passed the impugned orders without jurisdiction, it is within the power of this court to interfere under Article 227 of the Constitution.
(3.) I am not at the question whether this court could exercise its power under Article 227 of the Constitution as against the impugned orders passed by the Forum. May be, in appropriate cases, it s permissible as a statutory provision cannot curtail the power of this court under Article 227 of the Constitution.
