ADITHYA SHIVA PRASAD Vs. STATE OF KERALA

JUDGEMENT

(1.) Accused No.1 in Crime No.14/2022 of Excise Enforcement and Anti Narcotic Special Squad, Ernakulam, has filed this petition under Sec. 482 of the Code of Criminal Procedure, to quash Annexure 4 (order in Crl.M.P.No.2505/2022, dtd. 14/9/2022) and to release the petitioner on statutory bail in the above crime.

(2.) In this matter, the prosecution allegation is that the Assistant Excise Commissioner, Customs and party found 31 LSD stamps reached in the name of the accused and accordingly, the petitioner, to whom the said parcel was addressed, was arrested on 17/3/2022, alleging that he had committed offences under Sec. 20(b)(ii)(C), 21(b) r/w Sec. 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act ' hereinafter). Thereafter, the second accused was also arrested.

(3.) Heard the learned counsel for the petitioner as well as the learned Public Prosecutor.
