JUDGEMENT

(1.) This is an application for regular bail filed under Sec. 439 of the Code of Criminal Procedure, 1973.

(2.) Petitioner is the accused in Crime No.231/2022 of Payyannur Police Station. The offences alleged against the petitioner is under Sec. 354 A1(i), 354B, 354D1(i), 511 r/w 376 of the Indian Penal Code, 1860 and Sec. 10 r/w 9(f)(I)(p), 12 r/w 11 (iv) of Protection of Children from Sexual Offences Act, 2012.

(3.) The prosecution allegation is that the petitioner-a private teacher, who was engaged to teach the victim, attempted to commit rape on her, when she came to attend the tuition classes. It is alleged that on one occasion petitioner pressed on the breast of the victim and on another occasion, he attempted to molest her. On the basis of the complaint, the petitioner was arrested on 27/3/2022.
