JUDGEMENT

(1.) This is an application filed under Sec. 439 of the Code of Criminal Procedure.

(2.) The petitioner is the accused in Crime No.65/2020 of Kasaragod Excise Range. The offence alleged against the petitioner is punishable under Sec. 58 of the Abkari Act I of 1077.

(3.) The prosecution case is that the petitioner, on 15/6/2020, was found in possession of 17.28 litres of Indian Made Foreign Liquor meant for sale in the State of Karnataka near Peace Public School in Shiribagilu Village.
