JUDGEMENT

(1.) This is an application seeking pre-arrest bail filed under sec. 438 of the Code of Criminal Procedure, 1973.

(2.) Petitioner, who is the Sub Inspector in Kuttikkanam KAP 5th Battalion is an accused in Crime No. 986/2022 of Kazhakkoottam Police Station, Thiruvananthapuram, alleging offences punishable under Sec. 376(2)(n) of the Indian Penal Code, 1860.

(3.) According to the prosecution, the accused who had acquainted the victim through 'Messenger' and after convincing the victim that he had separated from his wife, promised to marry her and from 25/4/2022 till 4/6/2022 resided with her and committed rape and later when the victim became pregnant, the accused backed out of the marriage and thereby committed the offences alleged.
