NIDHIN MANOJ Vs. STATE OF KERALA

JUDGEMENT

(1.) This is an application seeking regular bail filed under Sec. 439 of the Code of Criminal Procedure, 1973.

(2.) Petitioner is the 1st accused in Crime No. 1272/2022 of Kanjirappally Police Station, Kottayam District. The offences alleged against the petitioner are under Ss. 366A, 376, 376(2)(n) and 109 r/w Sec. 34 of the Indian Penal Code, 1860 apart from Sec. 4 r/w Sec. 3, Sec. 9(l), and Sec. 17 r/w Sec. 16 of the Protection of Children from Sexual Offeces Act, 2012.

(3.) According to the prosecution, the accused committed penetrative sexual assault on the victim, aged 17 years, on 12/9/2022 as well as on four earlier occasions, after kidnapping her from Balika Bhavan and the offences were abetted by accused Nos.2 and 3.
