XXX Vs. STATE OF KERALA

JUDGEMENT

(1.) This is an application for regular bail filed under Sec. 439 of the Code of Criminal Procedure, 1973.

(2.) Petitioner is the sole accused in Crime No.782 of 2022 of Guruvayoor Police Station registered for the offences punishable under Ss. 354, 354B, 324, and 506 of the Indian Penal Code, 1860 apart from Ss. 8, 7, 10, 9(l)(n) and 21(1) of the Protection of Children from Sexual Offences Act, 2012 and Sec. 75 of the Juvenile Justice (Care and Protection of Children) Act 2015.

(3.) The prosecution case is that, the accused, who is the stepfather of the victim, committed sexual assault on the victim by pressing on her breasts and thereby committed the offences alleged.
