SETHURAJ Vs. STATE OF KERALA

JUDGEMENT

(1.) This is an application for regular bail.

(2.) The petitioners are accused in Crime No.50/ 2022 of Narcotic Enforcement Squad, Adimaly, alleging commission of offences punishable under Ss. 8C r/w Ss. 20(b), (ii) B, 29 and 25 of NDPS Act.

(3.) The prosecution allegation is that on 28/07/2022 at about 04:30 P.M. the Circle Inspector of Anti Narcotic Enforcement squad and party was on patrol duty, near Ambazhachal Junction they intercepted a motor bike bearing registration number KL- 69- A- 4208. It is the further case of prosecution that accused No. 1 was the rider and accused No. 2 was the pillion. It is alleged that a bag was seen kept in midst of them and on verification it was found that the said bag is containing 2. 072 Kg of ganja and thereby the accused have committed the aforesaid offences.
