(1.) HEARD the learned counsel for the appellant and the learned Standing Counsel appearing for the Panchayat.
(2.) IT is not in dispute that the appellant approached the respondent Panchayat for a licence to conduct business in vegetables in room No.1/84E. The said request for licence came to be rejected by intimation at Ext.P2 intimating the appellant that a resolution was passed and adopted by the respondent Panchayat as early as on 23.05.2006, wherein there was a decision to shift vegetable and fish businesses to another demarcated area of the Panchayat. As there was such a resolution of the concerned committee of the Panchayat, apart from rejecting the licence, they even issued notice to stop the continuation of the business by the appellant.
(3.) ACROSS the Bar, the learned counsel appearing for the respondent Panchayat informs, factually the appellant has changed the nature of business itself by starting a provision store. In that view of the matter, we are of the opinion, the only requirement would be to seek for necessary licence from the Grama Panchayat. The learned counsel also submits that if at all the appellant intends to continue the vegetable business and shift the said business to a demarcated area, the Panchayat will allow. We grant another two months time from today to the appellant to do the needful to comply with the directions of the learned Single Judge. With these observations, the appeal is disposed of.
