(1.) THE petitioners herein are the students of the Government Law College, Thiruvananthapuram. They are aggrieved by the orders, including the order passed by the Government as per Ext.P1, and the communication thereafter issued by the Warden directing them to vacate from the Men's Hostel.

THE main challenge in the writ petition is against Ext.P1 order dated 28.05.2012 wherein after referring to a Government Order dated 01.10.2002, the Government directed the Principal to close the Men's Hostel with immediate effect and take steps to implement the orders of the Government dated 22.06.2002. The consequential direction is to the Director of Collegiate Education to take further steps to accommodate the present inmates in the Law College Hostel in the University Men's Hostel, Palayam, Thiruvananthapuram. Thereafter, notices were issued by the Warden directing the students to vacate the premises and Ext.P2 evidences the same. Ext.P3 is stated to be a representation filed by the lady students to the Government. The main point that is raised in the writ petition is that Ext.P1 order cannot survive as it is violative of Article 14 of the Constitution of India and as there are no valid reasons to support it.

WHEN the matter came up for hearing further on 28.06.2012, it was submitted by the learned Government Pleader that so far no applications have been submitted by the petitioners for getting admission in the University Hostel. The 1st petitioner had filed an affidavit on 26.06.2012 stating that the Men's Hostel to which they have been alloted is uninhabitable and maintenance work is in progress. But even as on today, the petitioners have not filed any application for admission in the University Hostel. There are controversies as to whether students are at strike or they are only voicing their grievances before the Principal. But, still it is a fact that they have not filed any application in tune with the interim order passed by this Court.
