JUDGEMENT

(1.) The petitioners herein have approached this Court seeking for a direction to the respondent Bank to keep in abeyance the proceedings for recovery for a reasonable period for getting maximum price to their agricultural produces and also to grant instalment facility. The petitioners are relying upon the judgment of this Court in 22511/2012, produced as Ext.P2.

(2.) The petitioners are farmers by profession and engaged in cultivation of ginger, paddy and turmeric. They have been provided agricultural cash credit limit as produce marketing loan against ware house receipts subject to further guarantee of 2 guarantors. The loans are to be repaid within six months generally.

It is averred in the writ petition that due to considerable reduction in the price of agricultural produce in the market, the produces could not be sold and the agricultural produces are stored in dry form in the ware house. The price of commodities are fluctuating frequently. According to them, if the commodities are sold in April - May, 2013 it may fetch a W.P.(C).No.25070/2012 -2 - very appreciable price also, otherwise that may cause huge loss to them. These matters were brought to the notice to the Bank, but they were served with lawyer notices and one of such notice is produced as Ext.P1. It is submitted that the same contentions have been accepted by this Court in Ext.P2 judgment.
