(1.) PETITIONER has approached this Court seeking the following reliefs:
(2.) BRIEFLY put, the case of the petitioner is as follows: Petitioner is running a business in gold, for which he has licence. He borrowed an amount of '.12,00,000/= from the third respondent who is a financier. He could not repay the amount. Petitioner, upon being troubled and threatened, transferred his residential house to the third respondent. Third respondent is refusing to return the documents to the petitioner and he is demanding '.10,00,000/= more and he is threatening the petitioner and members of his family that unless the petitioner pays the said amount, he will not allow the petitioner and his family members to live in Thrissur and that they would be killed. Petitioner filed Ext.P1 complaint and is before us.
(3.) LEARNED Government Pleader would point out that the petitioner borrowed money and gold, promising to repay the amount with interest and thereafter the petitioner could not be traced. Two luxurious cars were purchased by the petitioner. Essentially, it is a matter relating to financial dealings between the parties. In view of the apprehension of the petitioner and in view of the third respondent refusing to appear, we dispose of the Writ Petition as follows:
