JUDGEMENT

(1.) THE petitioner is the first accused in Crime No.307/2012 of Hosdurg Police Station. THE offences alleged against him and other accused are under sections 341, 326 and 308 r/w 34 of IPC.

(2.) THE incident allegedly took place at 7.00 PM on 09.04.2012. It is alleged that accused persons 1 to 3 in furtherance of their common intention, attacked the complainant with iron rod on his hands, legs and other parts. THE blow was aimed at the head of the complainant. Had he not swerved his head or warded off the same, the blow would have fallen on his head which would have resulted in his death.
