(1.) THIS Writ Petition under Article 226 is filed by the petitioner who alleges that Safana his love is being illegally detained against her wishes by the fourth respondent, her father. On considering this Writ Petition for admission, we directed the third respondent to depute a Woman Civil Police Officer to the house of the fourth respondent for the purpose of interacting with Safana for finding out whether there is any truth in the allegation that Safana is cribbed, cabined and confined by the fourth respondent against her wishes.
(2.) TODAY Sri. Suresh, the learned Government Pleader W. P. (Crl.) No. 532 of 2012 -2 -would submit that as directed by this Court, the Sub Inspector of Police, Sri. A.B. Vibin deputed a Woman Civil Police Officer by name Rajani to interact with Ms. Safana. It was submitted that such an interaction was made and the statement of Safana was recorded by the above Woman Civil Police Officer. The original of the above statement was in fact placed before us by the learned Government Pleader. We have gone through the above statement. The statement is to the effect that Safana had some love towards the petitioner while they were studying in Dar -Ul -Ulum Higher Secondary School at Pullepady, Ernakulam. After they left the school also they used to talk over telephone. About one and a half months before, the petitioner would go to Safana's house and would insist on Safana accompanying him. He threatened to commit suicide by cutting his vain with a razor blade. Under fear Safana became compelled to accompany him. Together they went over to Kollam to the house of a friend of the petitioner. However the family of the above friend was not prepared to accommodate Safana and the petitioner. The next day after roaming about in several places they would come back to Cochin. By that time the Mattancherry police apprehended them on the basis of a complaint submitted by Safana's father, the fourth respondent. The police after recording the statement would let Safana go along with her parents. The statement concludes by stating that at present she does not have any love or affection towards the petitioner. She regrets having left her house along with the petitioner earlier. According to her she is an absolutely free person and she is happily residing along with her parents. The statement given by Safana under her signature to the Woman Civil Police Officer on 01/11/12 will be annexed to this judgment. The only question which we are called upon to decide in this Writ Petition is whether the Writ of Habeas Corpus sought for is liable to be granted. The above question necessarily has to be answered in the negative. We do so. The Writ Petition is dismissed.
