(1.) APPELLANT is the petitioner. The writ petition is filed inter alia seeking revaluation of the marks awarded to the petitioner.
(2.) THE facts of the case discloses that as per Univerity rules the petitioner's paper [i.e. Paper II "Electric Drives"] was valued by a 'double evaluation system' and the petitioner got 29 marks and 42 marks. Since there was a difference of more than 10%, the University got it valued by a third examiner and the highest two marks were taken and the average was only 39 marks. THE petitioner required 40 marks for passing the examination. Since the petitioner has not passed in the examination, the writ petition is filed with the following prayers:
(3.) RULES provide only for one revaluation by a third examiner and there cannot be a revaluation by a fourth examiner. In the absence of any provision for further evaluation of the answer papers of the appellant/petitioner, we do not find any reason to interfere with the judgment of the learned Single Judge. There is no merit in the above writ appeal and hence dismissed.
