JUDGEMENT

(1.) THE writ petition is filed by the petitioner seeking for a direction to release the goods to the petitioner, imported under the Air Waybill No.065- 6505 7403 dated 01/07/2012.

(2.) SHORTLY stated, the averments in the writ petition show that he is a Non Resident Indian working in Saudi Arabia and while coming to India at the time of Ramzan, he had brought few items as unaccompanied baggage under the above Air Waybill which included dry fruits which was expected to be used at the time of Ramzan for distribution to friends and relatives, as well as the petitioner's used house hold articles as the petitioner was shifting his work to other company.

GOING by the averments in para.2 of the Statement, it can be seen that the Air Waybill concerned is the subject of Crime No.RC14(A)/ 2012 CBI, Kochi and a case is registered on 14/08/2012 against 7 accused persons including 4 customs officials and 3 customs agents for offences punishable under Section 511, 420 Indian Penal Code, 1860 and Section 13(1) (d) read with 13(2) of the Prevention of Corruption Act.
