(1.) THE complaint in both these Writ Petitions is regarding the alleged pollution caused by a saw mill and a furniture manufacturing unit conducted by the petitioner in W.P(c) No.7872 of 2012. The petitioners in W.P(c) No.12959 of 2012 are local residents, who are complaining against the alleged nuisance caused by the units. Advocate Babu S.Nair, who appears for the Proprietor of the Unit submits that he has already granted a consent from the Kerala State Pollution Control Board. Advocate M.Ajay, who appears for the Kerala State Pollution Control Board submits that consent has been granted after ensuring that the Proprietor of the unit had satisfied all the conditions stipulated by the Pollution Control Board. Therefore, there is no possibility of any further nuisance or pollution from the unit.
(2.) THE learned counsel for the local residents on the other hand disputes the above submissions. According to the learned counsel, the nuisance and pollution caused, is insufferable. It is also alleged that the inspection alleged to have been conducted by the Pollution Control Board was without any notice to the local residents, though they had been constantly complaining against the working of the unit. Therefore, he seeks the issue of a direction for the conduct of a fresh inspection with notice to all interested parties.

THE learned counsel for the Panchayat submits that no application for renewal of licence has been submitted by the proprietor of the unit, supported by necessary documents like consent of the Pollution Control Board, N.O.C from the Forest Department, etc. For the above reason, the Panchayat has not issued any licence to the unit.
