JUDGEMENT

(1.) PETITIONER has approached this Court seeking the following reliefs :-

(2.) BRIEFLY put, the case of the petitioner is as follows :- The petitioner is a society registered under the Societies Registration Act bearing Registration No.401/91. There are 9 Mosques, 5 Madrassas and 1500 houses under it. The petitioner is managed by a committee of 21 members. The petitioner has been rendering services for the general welfare of the public and also to the members under it. The petitioner also intervenes if required for the settlement of minor disputes that arise between the members and initiate steps to settle the same amicably. The services rendered by the petitioner has been continuing for the last so many years and the residents are also aware of the same and co-operate fully with the activities of the petitioner. Social welfare activities being the purpose for which the society is registered, the same has been propagated by the petitioner without room for any complaints whatsoever. But taking advantage of the goodwill and the nature of work undertaken by the petitioner, the respondents off late, out of their enmity, have been indulging in activities detrimental to the interest of the petitioner. The petitioner and its members are living a life of fear and threat at the instance of respondents 5 to 12.

(3.) THE learned Government Pleader would submit that essentially there is a dispute between two factions.
