JUDGEMENT

(1.) This is an application filed u/s 438 of Code of Criminal Procedure seeking pre-arrest bail.

(2.) The petitioner is the accused in Crime No. 43/2021 of Valancherry Police Station. The offences alleged are under Sections 451, 341, 323, 427, 354, 354B and 506 of the IPC.

(3.) The prosecution case in short is that on a day in December, 2020, the petitioner trespassed into the dry clean center namely, Modern Dry cleaning owned by the victim, assaulted her, damaged her phone by crushing on the ground and on another occasion, caught hold of her churidar and torn it off with the intend to outrage her modesty and thereby committed the offences.
