JUDGEMENT

(1.) Application for regular bail under Section 439 of Cr.P.C.

(2.) The prosecution case, in brief, is that on 09.12.2020 at about 7 p.m. owing to previous animosity towards the de facto complainant, the applicant trespassed into the courtyard of his house and with intention to commit murder stabbed him with a knife. However, the de facto complainant evaded that and escaped with a lacerated injury.

(3.) The applicant states that the allegations are not true and that there was scuffle, in which the applicant also sustained some injuries and that there was no intention to murder and the injuries allegedly sustained by the de facto complainant are not grave in nature. The de facto complainant had enmity with the applicant because two years ago, the de facto complainant's daughter in law had eloped with the applicant and it is for that reason that he is a aggressor and had attacked the applicant with a knife. The applicant states that he has been in custody since 13.12.2020 and the investigation is almost complete and therefore he may not be incarcerated any longer.
