JUDGEMENT

(1.) This writ petition was filed by the petitioner when he was an octogenarian. Now he would be a nonagenarian person.

(2.) The petitioner was a public servant. The petitioner had served as Fisheries Development Officer in the Office of the Deputy Director of Fisheries at Kollam. He was indicted for committing the offences punishable under Section 5(1)(d) read with 5(2) of the Prevention of Corruption Act, 1947 (for short 'the Act') and also under Sections 419, 468, 471 and 120B of the Indian Penal Code (IPC).

(3.) The trial court found the petitioner guilty of the offences alleged against him. The trial court sentenced him to undergo rigorous imprisonment for a period of one year and also to pay a fine of Rs.2,000/- and in default of payment of fine, to undergo rigorous imprisonment for a period of three months for the offence punishable under Section 5(2) of the Act. The trial court also sentenced him to undergo rigorous imprisonment for a period of one year each for the offences punishable under Sections 468 and 471 read with 120B of the IPC.
