(1.) THE petitioner and his brother Alavi have certain civil disputes. It is said that the court of first instance has decided on that matter and the same is pending in appeal. THE petitioner states that at the instance of Alavi, the Sub Inspector of Police who is arrayed as the third respondent herein, had repeatedly required him to come over to the Police station and to wait there and also threatened to manhandle him. If these are the allegations against the Sub Inspector of Police and if those allegations institute a complaint on grave misconduct of the police officer concerned, the petitioner has appropriate statutory remedy in terms of the Kerala Police Act, 1960. This is more so because as of now, in terms of the provisions of Chapter III A of that Act, Police Complaints Authorities have been established at the state and district levels and any complaint against alleged misconduct of the third respondent could be attended to appropriately by the district authority which consists of a retired District Judge as Chairman, the District Collector and the District Superintendent of Police as members. We record the submission of the learned Government Pleader that such Complaint Authorities have been constituted at state level and district level throughout the State. We do not find any need for us to probe into such allegations. It is for the petitioner to move the appropriate authority. Without prejudice to that course, this writ petition is closed.
