JITHA K.J Vs. MAHATMA GANDHI UNIVERSITY

Decided On December 18, 2020
Jitha K.J Appellant
V/S
MAHATMA GANDHI UNIVERSITY Respondents

JUDGEMENT

(1.) The petitioners in these two cases - which are being heard together on account of the analogous facts pleaded and the similar nature of reliefs sought for - are stated to be students pursuing legal studies with the Bharath Matha School of Legal Studies (BSOLS). According to them, they were not allowed to write their 7th and 8th semester LLB Examinations for the reason that there was shortage of attendance in the earlier semesters; and they, therefore, pray that their applications for condonation of shortage of attendance be directed to be considered by the competent Authority of the Mahatma Gandhi University, so that the results of their examinations - which have been written by them under the interim orders of this Court - be published.

(2.) When this matter was called today, the learned counsel for the petitioners, submitted that on account of the various interim orders that have already been issued in these cases, the University has now given the petitioners a communication that their applications for condonation of shortage of attendance have been acceded to; and prayed that they be directed to publish the results of their 7th and 8th semester examinations.

(3.) In response, the learned Standing Counsel for the University - Sri.Asok M. Cherian, submitted that if the applications for condonation of shortage of attendance of the petitioners have already been allowed by the University, then there is no legal impediment in the results of their 7th and 8th semester examinations being published. He prayed that this Court may grant his client at least a month to do so.
