JUDGEMENT

(1.) Application for pre-arrest bail.

(2.) The petitioner is the 12th accused in Crime No.89 of 2020 of Kattakkada Police Station registered for the offences punishable under Sections 143, 147, 148, 447 and 302 read with Section 149 of the Indian Penal Code.

(3.) The prosecution allegation is that one Sangeeth, the deceased in this case, was having some property at Kanjiravila, Alamkode. On 24.01.2020 at about 00.30 hours he got information that certain persons are illegally removing soil from his property. He immediately rushed to his property in his car and then he found the first accused along with some of the accused persons excavating soil from his property by using a JCB excavator bearing Registration No.KL 74 4500. Two tipper lorries bearing Registration No. KL 20 C 5407 and KL 20 K 3145 were also there to remove the excavated soil from the property. Since the accused were engaged in removing soil illegally from his property, he objected the same.
