(1.) The petitioners were enrolled in the Central Industrial Security Force (CISF for short) in the year 1997. Thereafter, in the year 2005, restructuring of posts was undertaken in the CISF permitting induction of drivers to the rank of Constable by creation of temporary posts and simultaneous abolition of equal number of posts of Head Constable (Driver). Thus, the entry level being the post of Constable, the Head Constable post became a promotional post.

According to the petitioners, in the newly created promotion post, the Head Constables were granted basic pay of Rs 7,510/- and grade pay of Rs 2,400/- across all other branches with effect from 1.1.2006, pursuant to the recommendation of the sixth Central Pay Commission. But, the petitioners were granted basic pay of only Rs 6,750/- instead of Rs 7,510/-. Although, the petitioners were promoted as ASI/EXE in the year 2012, they are entitled to the benefit
(3.) According to the petitioners, the High Court of Delhi in WP(C) No.10660/2016 had accepted the contentions of similarly situated employees and by Ext P5 judgment granted them pay fixation of basic pay at the rate of Rs 7,510/-.
