(1.) The petitioner approached this Court questioning the legality of the order passed by the District Collector. This order passed by the District Collector purportedly under the Manual of Guidelines to Prevent and Control Communal Disturbances and to Promote Communal Harmony, 2005 Government Order.
(2.) The 4th respondent approached the Kollengode Grama Panchayath to re-construct a Temple. The Panchayath referred the matter to the District Collector. Thereafter, the District Collector passed this order.
(3.) There appears to be some civil disputes between the petitioner and the party respondent. The main grievance of the petitioner is that the District Collector permitted the 4 th respondent to re-construct the Temple referred to in the land mentioned in the impugned order. According to the learned counsel for the petitioner, the District Collector cannot decide an issue related to the right of a party in the land and at the best, the District Collector can only grant permission for establishing a place of worship in the area without referring to a land if there is any dispute between the parties.
