(1.) The petitioner, who is Managing Director of a Security Service Agency, has filed this writ petition for issuing a writ of Mandamus to the respondents to implement all the Regulations in the Private Securities Act, 2005 and the Kerala Private Securities Agencies Rules, 2010 scrupulously forthwith.

The petitioner states that petitioner's organisation has been complying with the statutory guidelines to provide necessary training, financial benefits, minimum wages and insurance benefits to the Security Guards engaged by him. However, majority of private security agencies in the State have been violating statutory rules and guidelines. Huge number of illegal private security agencies are functioning in the State.

The petitioner states that the Government has enacted Private Security Agencies (Regulation) Act , 2005 to contain security implications that is caused from the poor management of the Security Guards in the country. The Act is intended to ensure availability of well trained Security Guards. The Act provides for grant of licence to every private security agency. The security agencies registered are expected to give necessary training to Guards. Class room instructions and field training are also contemplated. Rule 5(2) of the Kerala Private Securities Agencies Rules, 2010 provides syllabus of the training to be imparted to Security Guards. Issuance of training certificates, is also contemplated.
