(1.) The petitioner says that he is a randonneur and had suffered sprain and other muscular and ligamental injury on account of extensive practice and consequently, had been laid up during the time when he was pursuing his 8th semester of BA (Criminology) LLB (Hons) with the 3rd respondent-College; and therefore, prays that his shortage in attendance be directed to be condoned by the University at the earliest.
(2.) The petitioner says that he has already completed his course and that he is now preparing to write the 9th and 10th semester examinations, but apprehends that he will be refused such opportunity if his attendance shortage in the 8th semester is not condoned. The learned counsel for the petitioner, Smt.Gayathri Muraleedharan, therefore, prays that the respondents be directed to condone the shortage of attendance and permit her client to write the examinations without any impediment.
(3.) In response to the afore submissions of the petitioner, Sri.Asok M. Cherian, learned Standing Counsel for the University, submitted that the petitioner had, in fact, shortage of attendance in three semesters, namely, 2nd,5th and 8th, of which, the shortage in the 2nd semester has already been condoned. He submitted that as regards the 5th semester is concerned, even though an application has been made, there were some defects and that the same has been sent back to the 3 rd respondent-College for resubmission, after curing all the defects. He then submitted that since the applicable Regulations of the University stipulate that a student will be allowed to seek condonation of shortage of attendance only twice in the entire course, the same in the 8th semester may not be possible.
