(1.) The review petition has been filed challenging the judgment dated 9.10.2018 in W.P.(C).No.32860/2018 with a delay of 593 days in filing the review petition. The review petition is filed inter alia contending that there is error apparent on the face of record. A counter affidavit has been filed on behalf of the 4 th respondent. The issue projected relates to the admission of Non-Keralite students for BSMS course in the 5th respondent college during the academic year 2016-17 and 2017-18. The 5th respondent college had challenged the orders passed by the Admission Supervisory Committee by filing W.P. (C).Nos.28008/2018 and 28395/2017. The writ petitions were dismissed by a Division Bench of this Court by judgment dated 30.8.2018. A review petition came to be filed, which also was dismissed. The matter was taken to the Apex Court and the Special Leave Petition also came to be dismissed.
(2.) The judgment under review relates to a writ petition filed by a student who was admitted in the said college during the academic year 2016-17. The writ petition was dismissed inter alia observing that the writ petition filed by the college was dismissed by a Division Bench. At that point of time, the review petition was pending and accordingly it was observed that, if the review petition is allowed and ultimately the order passed by the Committee is quashed, it will be open for the student/petitioner to take advantage of the decision.
(3.) A fresh writ petition had been filed as W.P. (C).No.15992/2020 by two persons who had joined the course during the academic year 2016-17 and 2017-2018. Their contention is that, the substantial grievance of the students had not been considered in any of the earlier writ petitions which were initiated at the instance of the College and a student. In fact, W.P.(C).No.32860/2018 filed by a student came to be dismissed based on the judgment of the writ petitions filed by the college.
