JUDGEMENT

(1.) By the Court The challenge in this original petition is with regard to the validity of Exts. P-4 and P-5 orders passed by the first respondent the Deputy Director, Dairy Development, Idukki, superseding the elected committee consisting of the petitioners and appointing the respondent 2 to 4 as Administrators of the Karimpan Milk Producers Co-operative Society.

(2.) In Ext. P-l notice issued to the Secretary and President, the first respondent pointed out that during inspection held in the Society on 23.2.2000, the following defects were noticed :

(3.) In response to Ext. P-l, the President of the Society gave Ext. P-2 reply whereby the following explanations were offered in the matter of above irregularities : The deficit of one bag of cattle feed is actually not in existence. What happened was only that it was duly accounted in the day book; but by mistake it was omitted to be debited in the stock register. As regards the deficit of ghee, what happened was that there was breakage of two bottles while the office of the Society was shifted to a rented building. The inconsistency between the stock register and the day book has been rectified. The defect arose from non-completion of the records of the Society. The finding of excessive cash balance was in consequence of sale of milk on credit and because there was delay in entering the details in the day book in the matter of giving advance to the producers. There is no system of getting vouchers for sale of cattle feed. Since such an omission was pointed out in Ext. P-1, the system has, however, been introduced newly in the Society. The failure to get the accounts approved by the Committee arose from the fact that the former Secretary was placed under suspension in September, 1999. After the defects were pointed out the accounts have been brought up-to-date by employing a qualified temporary land. As regards the failure of the 6th petitioner to supply milk to the Society, the defect has since been rectified. It was also assured in Ext. P-2 that the defects pointed out will not be repeated in future.
