(1.) This is a second appeal filed by the tenant against the order of eviction passed by the Rent Control Tribunal, Delhi in R.C.A. No. 114 of 1975 under proviso (e) to Sub-section (1) of Section 14 of the Delhi Rent Control Act, 1958 dated August 25, 1997.
(2.) The suit premises consist of two rooms, located in mezzanine floor, one store, kitchen, bath, common latrine, gallery and a balcony. The eviction petition was filed by the landlord on February 19, 1969. It was contended in the petition for eviction that since the letting of the premises to the tenant, the landlord's children have grown up, inasmuch as one of his daughters was studying in M.A., one son was married, the other son was of a marriageable age. It was contended by the landlord that he was in possession of one bed room, one drawing room, stores, kitchen, bath and a latrine.
(3.) The learned Rent Controller, Jaspal Singh, by his order dated December 3, 1974 held that the accommodation in the possession of the landlord was reasonably sufficient for the requirement of his family. The petition for eviction was, therefore, rejected.
