MOHD SHAKIR Vs. STATE NCT OF DELHI

JUDGEMENT

(1.) THE missing person, Ms Kanika, who is now known as Zeenat, is present in Court. The petitioner Mohd. Shakir is also present as also his older brother Mohd. Shahid. The missing person?s father Mr Krishan Kumar (respondent No. 4) is also present.

(2.) WE have seen a copy of the school certificate which indicates the date of birth of Kanika (now known as Zeenat) as 20.08.1990. This indicates that she is over 18 years of age. According to the petitioner, which fact is confirmed by Kanika (Zeenat), they got married on 31.10.2008. Prior to the said marriage Kanika converted to Islam. At page 13 of the paper book a copy of the conversion certificate issued by one Maulana Qazi Riyazuddin Amini dated 31.10.2008 is placed on record. The nikahnama (marriage certificate) of the same date is also placed on record at page 14 and a translation of which is placed at page 15 of the paper book. We have also enquired from the girl as to whether she is willfully staying with the petitioner as his wife. She has answered in the affirmative. The petitioner's older brother Mohd. Shahid has also stated in Court that he and his parents have also accepted the marriage of his brother. He has also indicated that the couple is at liberty to reside with them. The girl's father is understandably unhappy because of the manner in which events have unfolded. However, although, it may take him some time to accept the said facts, he seems to be reconciled to his fate.
