JAGJIT SINGH WALIA @ JOJO Vs. STATE OF DELHI

Decided On April 18, 2009
JAGJIT SINGH WALIA @ JOJO Appellant
V/S
STATE OF DELHI Respondents

JUDGEMENT

(1.) There are cross-allegations against each other in this matter. While the complainant has made several allegations against the petitioner and his family members, it goes to show that the complainant has been treated with cruelty from time to time she has been harassed for demand of dowry etc. She has made detailed allegations in her complaint.

(2.) No doubt the complainant has been treated with cruelty from each and everyone from the family of the petitioner which mayor may not justify. However, in so far as the allegations of the petitioner against the complainant are concerned they are also very vague allegations and have not been supported by any evidence. It is stated that a complaint has been filed by the petitioner against the complainant which is pending in the Court of Shaili Arora which was filed on 22.2.2008 but till date no evidence has been led on behalf of the petitioner.

(3.) In these circumstances, I do not find that the petitioner husband is entitled to any protection of this Court. As such his application is dismissed but the others namely his mother and sister-in-law and brother-in-law are directed to the released on bail in the event of their arrest on furnishing a bail bond in the sum of Rs.25,000 each with one surety each in the like amount to the satisfaction of IO-Arresting officer subject to their joining investigation.
