JUDGEMENT

(1.) JUDGMENT , J.

(2.) M/s Regal Scale Industries (the contractor) entered into a contract with the Union of India for supply of one Weigh Bridge Model DLA - 403 capacity 20 MT. Formal agreement bearing A/T. No. SDP-2/107 5705/4-7-80/92/PAOD/188 dated 6th March 1981 was executed by the parties. This agreement was governed by an arbitration clause. The dispuies having arisen between the parties, they were referred to the sole arbitration of Dr. B.N. Mani. Additional Legal Adviser to the Government of India, Ministry of Law and Justice, New Delhi (the arbitrator). The arbitrator entered upon the reference and made his award dated 6th May 1987 which he filed in the court.
