JUDGEMENT

(1.) This appeal assails judgment, dated 14th August, 2014, passed by the learned Special Judge (NDPS), whereby the appellant stands convicted of having committed the offences contemplated under Section 21(c) and 23(c) read with Section 28 of the Narcotic Drugs and Psychotropic Substances Act , 1985 (hereinafter referred to as the " NDPS Act "), and the consequent order, dated 19th August, 2014, whereby the appellant stands sentenced, for the said offence, to 10 years rigorous imprisonment with fine of ?? 1 lakh and default simple imprisonment of 3 months, for each of the aforementioned offences, the sentences being directed to run concurrently.

(2.) The issue in controversy stands covered by the judgment in Mohan Lal v. State of Punjab , (2018) SCC OnLine SC 974 and Arif Khan v. State of Uttarakhand, (2018) SCC OnLine SC 459. As such, it is not necessary to dwell deep into the facts of the case. An overall view, thereof, to the extent it is necessary to justify the present judgment, would suffice.
