(1.) The present appeal arises out of the award dated 3/8/1999 of the Motor Accident Claims Tribunal whereby the Tribunal awarded a sum of Rs. 1,75,360/- along with interest @ 9% per annum to the claimants.
(2.) Mr. Pradeep Gaur, counsel for the respondent insurance company refuted the said contentions of counsel for appellants and contended that the award passed by the tribunal is just and fair and requires no interference.
(3.) As regards the future prospects I am of the view that there is no sufficient material on record to award future prospects. PW4 Sh. J.N. Sharma deposed that the basic salary of repairer at DESU at the time of deposition was Rs.3,000/-. But in his cross examination he stated that he had not brought anything to show that the basic salary of repairer at DESU at the time of deposition was Rs.3,000/-. It is no more res integra that mere bald assertions regarding the future prospects of the deceased are of no help to the claimants in the absence of any reliable evidence being brought on record. In this regard the relevant portion of para 8 of the judgment in the case of Bijoy Kumar Dugar v. Bidya Dhar Dutta, (2006) 3 SCC 242 is reproduced below:
