(1.) THE petitioner seeks anticipatory bail in a case registered against him under Section 306 IPC. The FIR was registered at the instance of the father of the deceased. The present petitioner has been held responsible for abetting the deceased to commit suicide.
(2.) THERE is a letter stated to have been written by the deceased before putting an end to her life where the name of this petitioner appears. This letter is of peculiar nature where not only the petitioner is named but also speaks about the conspiracy between Delhi police and the gang of underworld where the name of this petitioner also appears. She also wrote that it was her last letter and that after this letter was exposed the petitioner and the police of Delhi Cantt. would kill her.
(3.) LEARNED counsel appearing for the petitioner urges that writing of such letter indicates that she suffered from mental ailment and, therefore, the letter contains meaningless materials. On the other hand, learned prosecutor urges that prior to the incident in question the FIR was registered against the petitioner and other persons by the deceased being FIR No. 209/2003 under section 354 IPC. The petitioner and other named persons wanted the deceased to compromise the matter otherwise threat was extended that she would be made prostitute.
