The dispute in this petition is as to whether the petitioner had sought admission to, and was granted admission in the BBA(General) course, or he had sought admission to, and was granted admission in the BBA (TTN) course by the respondent no.2 college under the 10% quota seats in the academic year 2007-08. The case of the petitioner is that he had applied for BBA (General) course under the management quota seats in the respondent no.2 college. He submits that he had been granted admission in the BBA(General) course and various receipts towards payment of fee etc were issued by respondent no.2 college which show that the petitioner was granted admission to the BBA(General) course. These receipts were issued on 7.8.2007. It appears that the petitioner attended classes in the BBA(General) course for a few days. According to the petitioner, on or about 20.8.20007, the respondent no.2 college informed the petitioner that he was admitted to the BBA(TTM) course and he was not permitted to pursue the BBA (Gen.)course. The petitioner was aggrieved by this action of the respondent college and his father made a representation on 31.8.2007 to the respondent college complaining that the petitioner had been shifted from BBA(General) to BBA(TTM) course illegally.
(2.) Another representation was made on 17.9.2007 by the petitioner's father. Since the respondent college did not revert the petitioner back to the BBA(General) course, the petitioner preferred the present writ petition in December, 2007.
(3.) The petition is opposed by the respondent University as well as by the respondent college. The respondent college along with its counter affidavit has placed on record the 'Student Information Form' stated to have been submitted by the petitioner on 7.8.2007. The said form mentions 'MGT(2007-10) TTM' as the course in which the petitioner sought admission. A copy of the application form dated 27.7.2007 submitted by the petitioner has also been placed on record.Against the column 'course applied for' it is mentioned 'BBA(Gen)/TTM'. Above TTM, there is a tick mark in the said form. According to the respondent, on 6.8.2007, the respondent college had issued a notice and put up the same on the notice board of the college declaring the names of the students who have beengranted admission, inter alia in the BBA(General) course and the BBA (TTM)course. The name of the petitioner finds mentioned at serial no.6 under the list of candidates for the BBA(TTM) programme.
