(1.) THE petitioner is aggrieved by an order dated 20th February 2007 whereby an eviction petition of the landlord (respondent herein) was allowed and the order of eviction was passed against the tenant (petitioner herein) and he was given six months" time to vacate the premises. At the time of admission, this Court had not admitted the petition on merits and a notice was issued to the respondent limited to the point of granting some more time to the petitioner to vacate the premises.
(2.) THE counsel for the petitioner argued that the petitioner was an old person of 70 years and alone and had been living in the premises since long so he should be allowed to live in the premises till his death.
(3.) MORE than an year has elapsed since this petition was filed and since the order for eviction was made. The petitioner does not seek any specific time for vacating the premises but seeks unlimited period of time i. e. he should be allowed to live in the premises till his death. Once he dies, obviously he would not have to vacate the premises. Who knows for how many years he would survive. He is not an ailing person and if God has blessed him with long life, he may live for another 30 years. The time cannot be granted to the petitioner till he dies because that would in fact make the decree a nonest and nullity.
