JUDGEMENT

(1.) The petitioner is engaged in the business of exhibiting cinematograph films and is running a cinema under the name and style of " Sheela Theatre " 70. In the year 1961 when the cinema was established, the petitioner framed rules for regulating the service conditions of its employees. ' Rules 7 (i), 7 (iv) and 18 of these rules which provide for suspension of employees read as under :

Respondent 2 challenged these rules as being arbitrary and unjustified and, therefore, raised a dispute for amendment of these rules and for incorporation of Cl 14(iV) of the Model Standing Order framed under the Industrial Employment (Standing Orders) Central Rules, 1946. The dispute was referred for adjudication by the Lt. Governor under order F-24 (614)/70-Lab., dated 25 Nov. 1970, to the Industrial Tribunal, Delhi, with the following terms of reference ;

(3.) Respondent 1 by his award, dated 21 Feb. 1973, published in Delhi Gazette, dated 3 May 1973, directed the petitioner, to incorporate the following additional rule 27 to the existing rules :
