JUDGEMENT

(1.) Crl. M. (Bail) No. 154 of 2017.

(2.) It is argued by Mr. Sumeet Verma, learned counsel for the appellant that the prosecution case rested on the accounts given by eye witnesses PW1 Manish Kumar Aggarwal and PW4 Jeevan Singh Rawat. It is contended that their testimony suffers from material contradictions inasmuch as according to PW1, the appellant had thrown the weapon of offence (i.e. the knife) to the co-convict Ritesh Verma with which he inflicted the stab injuries to the victim, resulting to his death. However, learned counsel for the appellant would point out that according to PW4, co-convict Ritesh Verma was carrying the knife with which he inflicted the injuries. It is submitted that this contradiction by itself would be sufficient to acquit the appellant.

(3.) The nominal roll reflects that the appellant had already undergone over 7 years and 3 months of incarceration as on 30th Jan., 2017.
