(1.) Present petition has been filed under Section 482 Cr.P.C. for quashing of F.I.R. No.450/2005 under Section 420/34 IPC, P.S. Connaught Place, New Delhi.

The brief facts of this case are that petitioner had an agreement with respondent No.2 to become their stockist and distributors and as per agreement, respondent No.2 had to invest certain sum with the petitioner towards the foodstuff stock. After receiving the amount, petitioner dispatched the foodstuff specially meant for children which was found to be of expiry date and accordingly, the foodstuff was returned back to the petitioner company and the present case was registered against the petitioners.
(3.) Thereafter, the matter was settled between the parties and bail application was filed before this Court. In the bail application it was stated that matter has been settled and as per terms of settlement of the criminal case, the petitioner has handed over Rs.1.5 lacs to the authorised representative of the complainant and the complainant shall take steps to get F.I.R. quashed or compounded. It was further mentioned in the bail order that this compromise shall not affect civil rights of the parties arising out of the transaction in question.
