IN these petitions under Section 482 Code of Criminal Procedure, the petitioner seeks quashing of criminal proceedings instituted at the instance of respondent/complainant on allegations of dishonour of several cheques aggregating to Rs. 3,23,940/-. During the course of proceedings, the petitioner had deposited the entire amount, namely, Rs.3,23,940/-. The respondent/complainant was permitted to withdraw the said amount by order dated 17th August, 2005. It did so subsequently. In these circumstances, the petitioner claims a quashing order.

Kapur, learned counsel for the respondent/complainant submitted that the withholding of amounts, which were due in the course of commercial transactions, caused prejudice to the complainant and some measure of compensation/interest ought to be directed. Mr. Manan, learned counsel for the petitioner fairly stated that a sum of Rs. 60,000/- would be paid in full and final settlement of such claims towards interest and compensation/costs for the period in question. A cheque No. 076051 in the name of M/s. Ganpati Enterprises drawn on Centurion Bank of Punjab Ltd. S-4, Green Park, New Delhi for Rs. 60,000/- was handed over to Mr. Kapur, learned counsel for respondent/complainant. In view of the submissions,, learned counsel for the respon- dent/complainant does not oppose the prayer of the petitioner, he is agreeable to the petitions being allowed, as the disputes between the parties stand resolved.
