JUDGEMENT

(1.) Heard. The petitioners and respondent No. 2 alongwith 9 other persons who were allegedly cheated by the respondent No. 2 and their co-accused are stated to have reached a compromise as detailed in Memo of Understanding dated 24th April, 2007. The petitioners had allegedly sold certain flats and shops as indicated in the said Memo of Understanding to the respondent No. 2 and 9 others without disclosing to them that the same had been constructed without a sanctioned plan. The respondent No. 2 and 9 others discovered this fact only on their flats and shops being sealed by MCD. The flats and shops were de-sealed on respondent No. 2 and said 9 others depositing compounding charges and demolishing unauthorized portions which could not be compounded. The petitioners have now compensated them as stated in Clause I of Memo of Understanding. Apart from Rs. 1,62,500/ which is acknowledged to have already been received by respondent No. 2 and 9 others another amount of Rs. 1,62,500.00 is now paid to them in the court today. In view of payments so received, the respondent No. 2 and 9 others named in the FIR, who are also present in person and are being identified by I.O. Mr. B.R. Sankhla have no objection against the FIR No. 28/2007 under Sections 420/406/34 Penal Code being quashed qua the present petitioners. On behalf of State also (d) there is no serious opposition in this regard. In view of the parties reaching amicable settlement and also keeping in view the nature of allegations, the petition is granted and the aforesaid FIR is quashed qua the petitioners. The petition is disposed of. Dasti.
