(1.) This petition under Article 226 of the Constitution of India has been made on behalf of the petitioner who is undergoing sentence under Sections 21/29 of NDPS Act for parole. He has sought parole for a period of three months on the ground that his family has got disintegrated and he wants to reconstitute his family.
(2.) The appellant has been sentenced to 14 years of Rigorous imprisonment and is in jail for 7 years and 7 months and his remaining sentence is 5 years and 5 months.
(3.) A perusal of the record shows that the appellant had been sentenced in another case being Sessions Case No. 35 of 2000 under Section 21/29 of NDPS Act. However, looking into the fact that he all along remained in jail for 7 years and 7 months, the appellant is granted parole for a period of 30 days, from the date of his release from jail, on his furnishing personal bond in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of Jail Superintendent.
